Course content
1.Introduction to business and human rights (interrelationship between human rights and business, multinational corporations) 2.Regulation of the conduct of multinational corporations: international law, EU law, national law 3.The United Nations Guiding Principles on Business and Human Rights 4.The OECD Guidelines for Multinational Enterprises 5.The State duty to protect human rights in relation to corporations 6.The European Convention on Human Rights and the jurisprudence of the European Court of Human Rights on the State duty to protect human rights against human rights abuses by business enterprises 7.The corporate responsibility to respect human rights 8.Accountability of corporations for human rights abuses, examples of national liability regimes 9.Access to remedy by victims of corporate abuses 10.Practical cases - environmental and climate change litigation before international and national courts 11.International investment law and human rights

  • Contact hours - 26 hours per semester

Knowledge
This course will be taught in English. The student is therefore expected to have a sufficient command of the English language and legal English terminology so as to be able to follow this course and to read, understand and orientate oneself in English-language texts relating to the subject matter.

On successful completion of this course, the student will: - be aware of the responsibility and role of businesses with regard to human rights - understand legal, economic, political and sociological issues that arise with respect to the obligations of businesses with respect to human rights - be familiar with the international and domestic efforts at enforcing accountability of business for actions contrary to human rights - be able to demonstrate knowledge and understanding of avenues for addressing corporate human rights abuses - be able to analyse and interpret relevant legal instruments, and identify key legal principles and issues - be able to conduct research focused on this subject area and will be familiar with the major literature and relevant legal instruments - be able to discuss on these issues and present reasoned arguments
