Course objectives:

To give students on the basis of legal practitioners' and legal researchers' experiences information in the field of modern Private International Law and European Private International Law.

Content
|
1. Definition, subject matter, sources of Private International Law and European Private
International Law, forms of regulation of the private legal relationships with international
element, unification of Private International Law on international and European level.
2. Choice of law rules, its classification, connecting factors,
3. Definition and resolution of the qualification problem in the Czech legal order and in foreign
countries, application of foreign law, renvoi,
4. The legal status of foreigners in private legal relationships with international element in
the Czech Republic and in foreign countries,
5. Uniform substantive law, sources, scope of application, relation of the choice of law rules and
uniform substantive law,
6. Application of the overriding mandatory rules in the Czech law and European Private
International Law,
7. Choice of law rules on the legal capacity, subjects of the Private International Law,
transnational forms of the companies (European Company and European Economic Interest Grouping),
8. Law applicable on obligations with the view to problematic of the law applicable on insurance
and consumer contracts,
9. Choice of law regulation of the law on succession and family law comparison of the Czech and
foreign legal regulation,
10. Choice of law rules on iura in re, labour law, law of exchange and law of cheque,
11. International regulation of the protection of industrial rights including problematic of law
applicable on international licensing contracts,
12. International and European Procedural Law with the focus on application of the Brussels I and
Brussel IIa Regulations,
