Tato práce se zabývá státním trestem jako jednou z mála společensky tolerovaných forem záměrného způsobení utrpení nebo jiné formy újmy, které jsou realizovány nezávisle na vůli dotčené osoby. Primárním cílem této práce je nastínit a posoudit argumentaci některých teorií ospravedlnění trestu, zejména pak klasického utilitarismu a retributivismu zásluhy. Velká část textu je věnována souvislostem mezi různými typy ospravedlnění, důvodů a teorií trestu. Část práce se též zabývá některými pojmovými znaky trestu

This Thesis deals with the State Punishment as one of the few socially tolerated forms of intentional infliction of suffering or other form of harm, that are inflicted independently of the will of the concerned person. The primary aim of this thesis is to outline and evaluate the arguments of some punishment justification theories, especially of classical utilitarianism and desert-based retributivism. A major part of the text is devoted to the links between different types of justification, reasons and theories of punishment. A part of the thesis also deals with some conceptual features of punishment.

This Thesis deals with the State Punishment as one of the few socially tolerated forms of intentional infliction of suffering or other form of harm, that are inflicted independently of the will of the concerned person. The primary aim of this thesis is to outline and evaluate the arguments of some punishment justification theories, especially of classical utilitarianism and desert-based retributivism. Cílem práce je vyhledat a zpracovat potřebné materiály k zadanému tématu, samostatně o něm teoreticky a kriticky pojednat a dospět k odůvodněným závěrům. Při zpracování budou využity metody kompilace, analýzy, interpretace a komparace.
1. Shromáždit a prostudovat literaturu ke zvolenému tématu.
2. Formulovat problémy, které budou v práci řešeny.
3. Předběžná snova:
a) Etická potřeba ospravedlnit trestání.
b) Pojmově vymezit utilitarismus.
c) Pojmově vymezit retributivismus.
d) Nestranná spravedlnost (B. Barry).
e) Spravedlnost jako vzájemná výhodnost (D. Gauthier).
f) Republikánská teorie (Braithwaite, Pettit).
g) Kontraktualismus (Rawls, Scanlon).
4. Pravidelně konzultovat s vedoucím práce.
5. DP vypracovat v souladu s platným rozhodnutím děkana O požadavcích na bakalářské a diplomové práce a o konání státních závěrečných zkoušek.
