Tématem diplomové práce jsou ?Specifika celního řízení v rámci propuštění zboží do režimu volného oběhu?. Cílem práce je v rámci tohoto celního režimu upozornit na některé specifické části, které v logickém sledu, v sobě obsahuje celní řízení. Práce si pro svůj omezený rozsah neklade za cíl postihnout celou danou problematiku. Nicméně je nutno konstatovat, že v posledních letech došlo k zásadním změnám v tomto odvětví, v souvislosti se vstupem České republiky do Evropské unie.
V úvodní části se nachází obecné vymezení pojmosloví a pramenů právních předpisů, se kterými je v další části pracováno. Následuje rozbor celního řízení v rámci propouštění zboží celního režimu volného oběhu. V této kapitole je uvedena i specifická úprava pro poštovní přepravu, která se zcela vymyká standardu.
V následujících kapitolách jsou popsány a rozebrány jednotlivé dílčí úseky v celním řízení a to: původ zboží, kombinovaná nomenklatura a zařazování zboží, celní hodnota. Rozbor je proveden jednak v obecně teoretické části a i v části praktické s ohledem na ustálenou judikaturu.
S pojmem celní hodnota jsou svázány dodací podmínky, proto je zde i krátký exkurz k tomuto pojmu, s následným povysvětlením vlivu na celní řízení.
Poslední řádnou částí každého rozhodovacího řízení, a to celní řízení je, je vydání rozhodnutí. V případě celního řízení se jedná o opravdu specifický úkon jednak s ohledem na evropskou ale i národní legislativu. V případě platební povinnosti je zde ještě nutno zohlednit právě evropskou úpravu ve smyslu sdělování celního dluhu.

The subject of this dissertation is ?Specifics of customs proceedings in the framework of releasing of goods into free circulation?. Its aim is to highlight some specific aspects of this customs procedure contained, in a logical succession, in the customs proceedings. With a view to its limited extent the dissertation does not aim to cover the whole range of this issue; nevertheless, it needs to be noted that recently there were some substantial changes in this area in connection with accession of the Czech Republic into the European Union.
The introductory part contains a general delimitation of terms and legal documents used in the dissertation. The following part analyses the customs clearance in the framework of releasing goods into free circulation. This chapter contains also the specific regulation of postal transport, which completely differs from the standard.
The following chapters describe and analyse the individual sectional aspects of the customs clearance which are: origin of goods, combined nomenclature and classification of goods, and customs value. The analysis is carried out in the theoretical part as well as in the practical part with a view to the established case law.
The concept of customs value closely relates to delivery conditions, therefore this part also provides a brief excursus to this issue followed by explanation of its impact on the customs clearance.
The final formal part of each decision making proceedings, including customs proceedings, is the issue of a decision. In case of the customs proceedings this is really a specific act from the point of view of both European and national legislation. It is necessary to highlight especially the European regulation concerning the notification of the amount of customs duty in relation to the payment obligation.
