Tato diplomová práce s názvem "Balistické zkoumání z kriminalistického hlediska a v trestněprávních souvislostech" se zabývá balistikou, kriminalistickou balistikou, úlohou a důležitostí znalce při balistickém zkoumání v trestním řízení a samotným balistickým zkoumáním. Také se zabývá střelnou zbraní z pohledu trestního práva a zákona č. 119/2002 Sb., o zbraních.
Annotation in English
The name of this diploma thesis is ?The criminological aspects of the ballistic research in criminal law conjunctions?. This diploma thesis deals with the ballistic examination in criminal law, possibility of using firearms between citizens and the role of ballistics experts in criminal proceedings.
The main reason for selection of this topic of for my diploma thesis is my interest in criminal law and criminology, especially in conjunctions with firearms and with related crimes committed with firearms. It is also necessary to point out, that crimes committed with firearms are very dangerous and the sum of these crimes is still growing.
The diploma thesis is composed of nine particular chapters. The first chapter is introductory and defines the basic terminology used in the whole diploma thesis: the ballistics and criminalistic ballistic. The next chapter of my diploma thesis deals with the firearms and their legal classification with historical look. I am also dealing in this chapter with the legal view of firearms under the Czech Arms Act No. 119/2002 Collection.
The main part of this diploma thesis is situated in chapter four, which deals with relationship between firearms and criminal law. This chapter of my diploma thesis deals with firearms and possibility of legal using of them between citizens and possibility of withdrawal or forfeiture of the firearm.
In chapter six of this diploma thesis I deal with classification of ammunition and his effect on the human body. Second main part of this diploma thesis is situated in chapter six and seven, which is focus on ballistic forensic examination cartridges, missile and no identification feet shot. The final chapter of my thesis I deal with other specific methods used in criminal detection ballistic examination. Conclusions of this rigorous thesis are drawn in chapter nine.
