Disertační práce je zaměřena na oblast soudní kontroly činnosti orgánů veřejné správy. Konkrétně pak na právní úpravu řízení ve věcech, o nichž bylo rozhodnuto jiným orgánem a problematiku s ní související. Ten, kdo tvrdí, že byl na svých právech zkrácen rozhodnutím orgánu veřejné správy, může se obrátit na soud, aby přezkoumal zákonnost takového rozhodnutí, nestanoví-li zákon jinak. Zákonný podklad pro možný ,,přezkum" rozhodnutí orgánů veřejné správy v oblasti soukromoprávní poskytuje § 7 odst. 2 z. č. 99/1963 Sb., občanský soudní řád (dále jen o.s.ř.). Přezkum rozhodnutí správního orgánu ve věcech veřejnoprávních upravuje z. č. 150/2002 Sb., soudní řád správní (dále jen s.ř.s.).
První část disertační práce je věnována historickému vývoji dané problematiky na našem území. Na první část práce navazuje část s ní úzce související, a to kapitola věnující se rozboru nálezu Ústavního soudu č. 276/2001 Sb., kterým byla s účinností k 1. lednu 2003 zrušena celá dosavadní část pátá občanského soudního řádu, upravující správní soudnictví na našem území.
Ve třetí části práce se podrobně věnuji tzv. dualismu práva, který v rodině právních řádů s kontinentálním systémem práva zastává klíčovou roli, a který se v notné míře promítá i do oblasti soudní kontroly činnosti orgánů veřejné správy.
V souvislosti s rozlišováním práva na právo veřejné a právo soukromé jsem nemohla nezmínit i tzv. kompetenční spory. Ke zpestření a lepší demonstraci této problematiky jsem si na závěr kapitoly dovolila zařadit mnou zvolený výběr judikátů zvláštního senátu zřízeného z. č. 131/2002 Sb., o rozhodování některých kompetenčních sporů, Ústavního soudu i soudů obecných.
Stěžejní část disertační práce je věnovaná současné právní úpravě řízení ve věcech, o nichž bylo rozhodnuto jiným orgánem obsažené v části páté občanského soudního řádu. V této kapitole jsem se pokusila nejen popsat celý průběh řízení dle této části, včetně jednotlivých institutů s ním souvisejících, ale také ho kriticky zhodnotit a v rámci úvah de lege ferenda nastínit možné úpravy této oblasti.

The main topic of the submitted thesis is the legal regulation concerning the judicial control of administrative bodies. The right to judicial and other legal protection arises from the article no. 36 of Charter of fundamental rights and basic freedoms, the judicial control of administrative bodies´ acts is concretely regulated in paragraph 2 of this article that states: ,,Unless a law provides otherwise, a person who claims that her rights were curtailed by a decision of a public administrative authority may turn to a court for review of the legality of that decision. Since this legal issue is very wide, I have decided to draw my attention mainly to the civil part of the judicial control of administrative bodies´ acts, in concrete to Chapter Five of the Civil Procedure Code (Act N. 99/1963 Coll.)
If administrative body decides about issues which within our legal system belong to private law matters, then this decision shall be, according to Chapter Five of the Civil Procedure Code, reviewed by civil court. On the other hand, if administrative body decides about issues which within our legal system belong to public law matters or if administrative body is inactive, this decision shall be, according to the Administrative Procedure Code, reviewed or this situation could be solved by administrative courts.
My thesis is divided into five chapters (each of them is then further divided), introduction and conclusion, ensembled with the list of used sources. The first chapter deals with the historical development of the legal regulation of the judicial control of the administrative bodies´ acts.
The second chapter of the thesis contains detailed analysis of the judgement of the Constitutional court N. 276/2001 Coll., by which the previous Chapter Five of the Civil Procedure Code was annulled.
The third chapter of the thesis deals with basic analysis of the questions concerning the so called legal dualism, thus distinction between the two basic branches of law, private law and public law. This distinction determines which case will be reviewed by administrative court and which case will be reviewed by civil court.
The analysis of the legal regulation of the conflicts of competence between the civil and administrative courts is contained in the fourth chapter of the thesis called The conflicts concerning the competence. Because of the extensive decision-making activity of this senate and other courts it was not possible to compile all the decisions of the court, the decisions included in thesis are therefore result of a precise selection.
The fifth chapter of the thesis deals with the main topic of the thesis, proceedings concerning cases which were decided by a different body according to Chapter Five of the Civil Procedure Code. It summarizes the whole course of the proceeding, from the commencement (by filling the complaint) to the decision, with the critical remarks to some questions and also with proposals de lege ferenda.
