Tématem předložené disertační práce je ?Přirozenoprávní zhodnocení ústavního zakotvení práva vlastnického a práv sociálních v ČR?. Autor v práci vychází z moderního non-pozitivismu (zejm. Rawls, Dworkin, Alexy) v jeho umírněné formě, chápající jako nutnou podmínku platnosti práva jeho elementární spravedlnost.
Cílem práce je komplexní analýza a zhodnocení postavení sociálních práv a vlastnického práva v právním řádu ČR, spojená s posouzením legitimity tohoto stavu, jeho příčin i důsledků ve statické i dynamické rovině, jakož i formulace možných změn de lege ferenda.
Zjištěný stav konfrontuje s referenčními kritérii přirozeněprávních imperativů v práci formulovaných a nabízí přesvědčivou argumentaci vymezující se proti extrémním disproporcím mezi právním postavením práva vlastnického a práv sociálních z přirozenoprávních pozic, přičemž axiologickými i právními argumenty odůvodňuje potřebu vzájemně horizontálního právního postavení obou těchto kategorií.

The theme of the dissertation is "The natural rights evaluation of the constitutional anchoring of property and social rights in Czech republic". Author proceeds from modern non-positivism (especially Rawls, Dworkin, Alexy) in its moderate form, understanding of elementary justice as a necessary condition of justice.
The aim of this thesis is a complex analysis and evaluation of the status of social rights and property rights in the legal order of the CR, linked with an evaluation of the legitimacy of this condition, its causes and consequences at both static and dynamic levels, as well as possible changes in the formulation de lege ferenda.
The identified state brings confrontation with referential criteria naturally imperatives formulated in this work and offers a convincing argument defining extreme disproportions between the legal status of property rights and social rights from naturally positions, while axiologic and law arguments justify the need for mutually horizontal legal status of both categories.
