Diplomová práce je zaměřena zejména na hodnocení náhradního mateřství v právních a některých etických souvislostech v porovnání s vybranými zeměmi. V první části pojednává o náhradním mateřství obecně. Jsou zde vymezeny termíny typické pro realizaci náhradního mateřství a rozebrána některá etická dilemata plynoucí z realizace tohoto institutu. Druhá část se vztahuje k právní úpravě asistované reprodukce v souvislosti k náhradnímu mateřství a věnuje se návrhu smlouvy o náhradním mateřství. Třetí část řeší zahraniční právní úpravu. Konkrétně jsou uvedeny některé významné judikáty ze zahraniční judikaturní praxe. Součástí jsou také výsledky šetření vzniklého v rámci vypracování diplomové práce. V závěru diplomové práce se autorka pokusila zhodnotit, zda je současná právní úprava v ČR dostačující s přihlédnutím k současným trendům.

This thesis describes surrogate motherhood legislation in the Czech Republic compared to selected countries. Firstly, it describes how surrogacy is both the legal and the ethical problem, too. In the first part are mentioned some terms which are typical for surrogacy. It deals with surrogate motherhood in the ethical context and attempts to frame it as problem that needs be solved. The second part concerns the legal regulations of assisted reproduction with the focus on surrogacy connections. The third part discusses legal regulations in selected countries, focused on the judicature. The goal of the thesis is to evaluate if the legal regulations in the Czech Republic answer the needs of modern trends.
